Conditions of carriage
Excerpt from the General Conditions of Carriage
We would like to draw your attention in particular to Section 6 and Section 7 of the General Conditions of Carriage:
Section 6 Fares and tickets
Section 7 Increased carriage charge
Conditions of carriage & terms of use (T&Cs) for the facilities of LGO Liftgesellschaft mbH
Facilities of Liftgesellschaft Oberwiesenthal
The following conditions generally apply to the quad chairlift, the Flyline, the Jump & Slide Park and the Alpine Coaster.
Additional separate conditions may apply to individual facilities.
Section 1 Scope
(1) The General Conditions of Carriage, as posted, apply to the carriage of persons and items and to staying on the premises and facilities of LGO Liftgesellschaft.
(2) The railway premises include the entry point, the stations, the chairlift line, the exit point, the waiting and queuing areas of the quad chairlift as well as the Flyline and Alpine Coaster, and the fenced area of the Jump and Slide Park.
(3) Insofar as liability exists for hiking trails, ski runs, etc. on the part of the quad chairlift under the principles of the duty to ensure safety in public areas or for other reasons, reference is made to Section 9 (2). Use is at the user’s own responsibility, based on their own assessment of their personal ability. Reference is made to the general statutory provisions as well as internationally recognised rules of conduct (e.g. FIS rules of conduct for skiers and the DSV tips). These also form part of these T&Cs. Slope and trail markings should be observed in your own interest. Reference is made to the consequences specified in more detail in Section 5.
(4) The conditions of carriage form part of the contract of carriage. They apply to the carriage of persons and items as well as to conduct within the railway area. Fulfilment of the contract of carriage, and thus the validity of these conditions of carriage, begins upon entering and ends upon leaving the parts of the facilities dedicated to chairlift operation. By purchasing a ticket, the passenger acknowledges the provisions below and undertakes to comply with them.
(5) Please observe the separate provisions for the individual facilities.
Section 2 Order and safety
(1) Generally applicable provisions:
Signs regulating passenger conduct are binding.
Instructions given by the railway staff for operating the service, maintaining peace, safety and order within the cableway facility and in cableway traffic must be followed immediately.
Unless the cableway staff issue different instructions, it is not permitted to:
enter the cableway facilities and rooms in the stations that are not intended to be open to the public or passengers.
damage or soil the facilities, operating equipment and vehicles, create obstacles, set the railway or vehicles in motion without authorisation, operate devices serving operation or accident prevention, carry out other actions that disrupt or endanger operations, or climb the pylons. The person responsible must pay the costs of removing soiling and obstacles, or €100, unless they can prove a lower amount of damage.
board or alight at places other than those designated, or from the side of the vehicles other than the designated side.
leave the vehicles – even in the event of a disruption – outside the stations.
smoke during carriage.
deliberately swing in and with the chairs lengthwise or sideways during the ride, or change seats during the ride.
hold objects outside the vehicles or lift line, throw objects during the ride, or push off from the facility’s pylons.
After the ride ends, leave the vehicles and exit areas promptly in the indicated direction.
Any sports equipment you bring must not endanger passenger safety.
Section 3 Carriage of persons
(1) Operating times – first and last ride – are posted in the stations. Special agreements remain unaffected.
(2) Upon justified request by persons with physical disabilities, the vehicles will be stopped for boarding and alighting or their speed will be reduced. No guarantee is given that the facility is suitable for carrying such persons.
The following applies to the carriage of passengers:
Passengers without strapped-on winter sports equipment are carried uphill and downhill, while passengers with strapped-on winter sports equipment are carried uphill only. Depending on snow conditions, the cableway operator may require that the ride be taken only with strapped-on winter sports equipment. Winter sports equipment includes alpine skis, monoski, snowboard, swingboard (Swingbo), cross-country skis, firn gliders and short skis for skibobs.
When carrying passengers without strapped-on winter sports equipment, 4 persons are carried per chair. Carrying passengers with strapped-on swingboards is only permitted with the equipment dismantled and requires that the passenger uses only the sliding part of the equipment fitted with a binding during carriage.
A maximum of two persons with a skibob are carried per chair and must sit on the outer seats. Only passengers either with or without strapped-on winter sports equipment may be carried uphill in the same chair.
The following applies to passenger conduct before, during and after carriage:
Passengers must behave in such a way that the safety of cableway operations and passengers is not endangered and that order and operational procedures are not disrupted.
Passengers may only enter those railway facilities and rooms in the stations that are intended to be open to the public or passengers.
Passengers may only take a seat in the chair in the presence of the station attendant. Persons who require assistance when boarding or alighting must expressly inform the station attendant.
With consideration for fellow passengers, the safety bar must be closed immediately after taking the seat, kept closed during the ride, and opened only shortly before the exit point in accordance with the passenger notice.
Jumping off, swinging and standing up, as well as smoking, are prohibited during the ride. If the chairlift is stopped during the ride, passengers must remain calm and wait for instructions.
Holding out or throwing objects during the ride is prohibited.
After the ride ends, leave the exit area promptly in the indicated direction.
The prohibitions, requirements and notices applicable to chairlift passengers, usually indicated by symbol signs, must be observed.
The following applies to the carriage of children:
Children under 1.10 m in height must be carried on the lap of a suitable person or on the adjacent seat. The suitable person may accompany only one such child and must have nothing in their hands except ski poles.
Children between 1.10 m and 1.25 m in height may be carried alone on a chair seat if at least one seat is occupied by a suitable person, who must have nothing in their hands except ski poles.
An accompanying person is considered suitable in particular if, under the fare provisions, they are regarded as an adult and clearly appear capable of providing any assistance that may be required (e.g. opening and closing the safety bar).
Children over 1.25 m in height are carried like adults.
Carrying children on the lap of an accompanying person is permitted regardless of the child’s height, provided that space and weight conditions allow it.
Section 4 Carriage of items
(1) Bringing animals, hand luggage, sports equipment, etc. is permitted only insofar as this does not cause unreasonable disturbance or create hazards for persons, property or the railway. If additional seats are used, the railway may charge additional fees.
(2) Bringing firearms, explosive, highly flammable or corrosive substances is prohibited. You or your employer bear full liability for any damage resulting from carrying these items.
Section 5 Exclusion from carriage / withdrawal of ticket
(1) The following persons may be excluded from carriage:
those who violate the conditions of carriage or do not follow the instructions of the railway staff.
those who, through their own misconduct – including while queuing – cause unreasonable disturbance to passengers or significantly disrupt operations.
those who are intoxicated.
those who attempt to be carried without a valid ticket or with travel authorisation issued to another person, i.e. purchase lift passes from third parties that were not issued at the ticket offices of the Oberwiesenthal ski area (Kasse FSB GmbH and LGO mbH).
those who have contagious or repulsive illnesses or offend against decency, custom and morality.
(2) A ticket may be withdrawn permanently or temporarily from persons:
who endanger safety at cableway and lift facilities.
who disregard instruction and prohibition signs or do not follow the instructions of the railway staff.
who use blocked or closed slopes or ski off-piste (forest).
who ski recklessly and thereby endanger or injure other persons.
who behave in a way that damages operations towards LGO mbH. In cases under Section 5 (1) and (2), no refund of the fee will be granted.
(3) In addition to withdrawal of the ticket, reporting to the authorities in criminal or administrative offence proceedings remains reserved.
Section 6 Fares and tickets
(1) Use of the facilities is permitted only for persons who have purchased a ticket. The passenger is obliged to present the ticket for inspection at any time upon request and to carry it properly.
(2) Fares are posted in the stations or can be viewed at www.othal.de .
(3) Entitlement to reduced fares for groups, etc. exists only if they arrive as a closed group. Groups that are assembled only at the place of carriage cannot be recognised as such. In cases of doubt, passengers must prove that the requirements for a fare reduction are met.
(4) No compensation is granted in the event of loss or non-use or only partial use of a single or day ski pass or a points card.
(5) Partial refunds for multi-day ski passes after winter sports accidents are granted only in the case of a medically certified ski accident and immediate deposit of the ski pass at a ski pass sales point. For the refund, the relevant date is not the day of the accident but the day the pass is deposited. The amount of the refund is set out in the fare provisions.
(6) Tickets are non-transferable. Photo checks possible.
(7) Base fares may change from day to day due to dynamic pricing adjustments.
Section 7 Increased carriage charge
(1) A passenger is obliged to pay an increased carriage charge if they:
have not obtained a valid ticket.
have obtained a valid ticket but cannot present it during an inspection.
have not validated the ticket, or not immediately, when passing through the barrier or control point, or have not had it validated.
do not present the ticket for inspection upon request.
use a ticket unlawfully or are found with a forged ticket. Reporting to the authorities in criminal or administrative offence proceedings remains reserved. The provisions under numbers 1 and 3 do not apply if obtaining or validating the ticket did not take place for reasons for which the passenger is not responsible.
(2) The increased carriage charge under (1) is twice the fare intended for this carriage, but at least €25.
(3) Any further claims remain unaffected.
Section 8 Release from the obligation to carry
Events of force majeure, e.g. weather conditions, storms from 14 m/s, thunderstorms, lockouts, operational disruptions or unforeseeable circumstances that may impair the safety of operations, may postpone the obligation to carry for the duration of the disruption and an appropriate start-up period, or may cancel it if the issue cannot be remedied or cannot be remedied in time. In such cases, there is no entitlement to a refund. The cableway operator is obliged to provide carriage in accordance with the timetable if the applicable legal provisions and conditions of carriage, as well as the operator’s instructions issued in the interest of safety and order, are complied with.
Section 9 Liability and damages
(1) The railway is liable in accordance with the mandatory statutory provisions in force, in particular the Liability Act.
(2) The railway is liable for fault only if intent or gross negligence can be attributed to it, its legal representatives, executive employees or vicarious agents (including assistants).
Section 10 Data protection
Personal data of the passenger is collected, processed, stored and used in compliance with data protection regulations. To ensure passenger safety and cableway operations, and to prevent misuse of tickets, access areas – including temporarily – are monitored by a video system, and at some access points of the lifts, photo checks are carried out using electronic readers. This is indicated by notice signs. The passenger agrees to video surveillance and the recording of images. Recording is carried out exclusively to safeguard house rules and operational safety interests. The data is deleted without delay when it is no longer required to achieve the purpose. The relevant provisions of the Federal Data Protection Act are complied with.
Section 11 Lost property
Anyone who finds a lost item on the cableway premises and takes possession of it is obliged to hand it over to the cableway staff without delay in accordance with Section 978 of the German Civil Code (BGB).
Section 12 Limitation period
(1) For claims arising from the contract of carriage, the limitation period is otherwise governed by the general provisions.
- 13 Place of performance and jurisdiction
(1) The place of performance is the railway’s registered office.
- 14 Partial invalidity
Should individual provisions of these conditions of carriage be wholly or partially invalid or void, the remaining provisions shall remain binding.
